RESOLUTION TO CREATE TAX INCREMENT FINANCING DISTRICT
WHEREAS, Duane Sand has proposed to construct and invest in a 30 room chain motel for the City of Pembina;
WHEREAS, the construction and development of such motel will create economic advantages to the City of Pembina and its residents;
WHEREAS, those developing this motel have sought financial assistance from the City of Pembina through tax increment financing, as permitted under N.D.C.C. Chapter 40-58;
WHEREAS, the development of a motel, as proposed, is consistent with the City of Pembina’s Strategic Plan, adopted in 2001, which calls for the enhancement of business opportunities and enhancing of tourism opportunities;
WHEREAS, land for development of such community-enhancing commercial ventures, such as the proposed motel, is limited to areas along the Highway 59 by-pass, which includes Blocks, 74, 75 and 78 (the “Development Area”);
WHEREAS, the members of the governing body, having reviewed the Development Area and being fully apprised of the matter, supports such motel development and desires to pursue and create a tax increment financing district for the Development Area, in accordance with N.D.C.C. Chapter 40-58.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEMBINA, NORTH DAKOTA, ON THIS 3rd DAY OF JANUARY, 2005, UPON MOTION MADE BY Pat Burton , SECONDED BY John Feldman AND APPROVED BY THE GOVERNING BODY OF THE CITY OF PEMBINA:
A. Pursuant to N.D.C.C. § 40-58-05, the governing body finds and determines that one or more parcels of industrial or commercial property, as defined in N.D.C.C. Chapter 40-58, exist within the Pembina city limits, which parcels are contained within the Development Area.
B. Pursuant to N.D.C.C. § 40-58-05, the governing body finds and determines that the development, rehabilitation, and/or redevelopment of the Development Area is necessary in the interest of the public economy, health, safety, morals, and welfare of the residents Pembina.
C. Pursuant to N.D.C.C. § 40-58-06, the governing body of the City of Pembina finds and determines that the Development Area consists of industrial or commercial property, as defined in N.D.C.C. Chapter 40-58, and does designate the Development Area for a development or renewal project under N.D.C.C. Chapter 40-58.
